These Terms and Conditions govern the use of the website webnovacraft.com and the services provided by WebNovaCraft, a web design and development business based in Spain.

By accessing this website or engaging our services, you accept these terms in full. If you disagree with any part of these terms, please do not use our website or services.

• "We", "Us", "Our" refers to WebNovaCraft.
• "You", "Client", "User" refers to the individual or entity accessing our website or engaging our services.
• "Services" refers to web design, development, SEO, maintenance and any related digital services offered by WebNovaCraft.
• "Project" refers to any agreed scope of work between WebNovaCraft and the Client.
• "Website" refers to webnovacraft.com.

WebNovaCraft provides custom web design and development services, including but not limited to:

• Custom website design and development
• E-commerce development
• Landing page creation
• Figma to website conversion
• SEO and analytics setup
• Website maintenance and care plans

The specific scope, deliverables and timeline of each project are defined in a formal proposal or agreement provided before work begins.

Before starting any project, WebNovaCraft will provide a detailed proposal outlining the scope of work, deliverables, timeline and pricing. The project begins once the Client confirms acceptance of the proposal.

Any changes to the agreed scope may result in adjustments to the timeline and cost, which will be communicated and agreed upon before implementation.

WebNovaCraft does not require any upfront payment. Our payment structure is milestone-based:

• 30% after the first week of visible progress, confirming the continuation of the project.
• 30% once the main structure of the website is built and validated.
• 40% upon project completion, before final launch.

All payments are made via bank transfer. Payment details, due dates and bank information are clearly indicated on the proposal and corresponding invoices.

Late payments may result in the suspension of work until the outstanding balance is resolved. WebNovaCraft reserves the right to charge interest on overdue amounts in accordance with applicable Spanish law.

To ensure a smooth and efficient project workflow, the Client agrees to:

• Provide all necessary content, brand assets and materials in a timely manner.
• Review deliverables and provide feedback within agreed timeframes.
• Ensure that all content provided is accurate, legal and does not infringe on third-party rights.
• Communicate any changes to the project scope as early as possible.

Delays caused by the Client in providing materials or feedback may result in corresponding delays to the project timeline.

7.1 Client ownership

Upon full payment, the Client receives full ownership of the final website design, custom code and content created specifically for their project.

7.2 WebNovaCraft rights

WebNovaCraft retains the right to display the completed project in its portfolio and marketing materials unless otherwise agreed in writing.

Any proprietary tools, frameworks, templates or code libraries developed independently by WebNovaCraft remain the intellectual property of WebNovaCraft.

7.3 Third-party assets

Third-party assets such as stock images, fonts, plugins or software are subject to their respective licenses. WebNovaCraft will inform the Client of any third-party dependencies used in their project.

WebNovaCraft offers flexible revision rounds throughout the project to ensure the final result matches the Client's expectations.

Significant changes to the approved design or scope that fall outside the original agreement may be treated as additional work and quoted separately.

WebNovaCraft will deliver the completed website according to the agreed timeline. The final launch will proceed once:

• The Client has reviewed and approved the final version.
• All outstanding payments have been settled.

After delivery, the Client receives a 7-day support window for minor adjustments, along with full access credentials and documentation.

WebNovaCraft offers optional Website Care Plans for ongoing maintenance, security monitoring, updates and performance optimization.

Maintenance plans are billed monthly and can be cancelled with 30 days' written notice. Without an active maintenance plan, WebNovaCraft is not responsible for issues arising from outdated software, plugins or security vulnerabilities after the 7-day post-launch support period.

Either party may terminate a project by providing written notice. In the event of cancellation:

• The Client will be invoiced for all work completed up to the date of cancellation.
• Any payments already made for completed milestones are non-refundable.
• WebNovaCraft will deliver all completed work and assets to the Client.

WebNovaCraft will deliver all services with professional care and diligence. However:

• We are not liable for any indirect, incidental or consequential damages resulting from the use of our services or website.
• We do not guarantee specific results such as search engine rankings, traffic volumes or conversion rates.
• Our total liability for any claim arising from a project shall not exceed the total amount paid by the Client for that project.

WebNovaCraft is not responsible for downtime, data loss or security breaches caused by the Client's hosting provider, third-party plugins or actions taken by the Client after delivery.

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project. This includes business strategies, financial information, technical specifications and unpublished content.

This obligation does not apply to information that is publicly available, independently developed or required to be disclosed by law.

By using the WebNovaCraft website, you agree not to:

• Use the website for any unlawful or fraudulent purpose.
• Attempt to interfere with the website's functionality or security.
• Reproduce, duplicate or copy any content from the website without permission.
• Use automated tools to scrape or extract data from the website.

Our website may contain links to third-party websites. These links are provided for convenience only. WebNovaCraft does not endorse, control or assume responsibility for the content, privacy policies or practices of any third-party websites.

WebNovaCraft shall not be held liable for any delay or failure to perform its obligations if such delay or failure results from circumstances beyond its reasonable control, including but not limited to natural disasters, pandemic, war, government action, power failure or internet outages.

These Terms and Conditions are governed by the laws of Spain. Any disputes arising from these terms or the services provided by WebNovaCraft shall be subject to the exclusive jurisdiction of the competent courts in Spain.

WebNovaCraft reserves the right to update these Terms and Conditions at any time. Changes will be posted on this page with a revised "Last updated" date. Continued use of the website or services after changes are published constitutes acceptance of the updated terms.
